Terms of Service

1. Agreement to These TermsThese Terms of Service ("Terms") govern your use of beyondlikability.com, the MomentumDS client portal, and related services, communications and content (together, the "Services") provided by Beyond Likability Ventures, LLC "Beyond Likability", BLV," "we," "us" or "our"). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

2. Our ServicesBeyond Likability provides the Momentum Demand System ("MomentumDS"), a marketing demand system that includes social media strategy, creative, organic and paid social management, inquiry follow-up, booking workflows, a client portal and reporting. Services may be fully managed by us or self-managed by the client. The scope, fees and term of any paid engagement are set out in a separate written agreement, order form or proposal ("Client Agreement"). If these Terms conflict with a signed Client Agreement, the Client Agreement controls.

3. Business Use and EligibilityThe Services are intended for businesses. You must be at least 18 years old and authorized to act on behalf of the business you represent.

4. Accounts and Client PortalYou are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly at mailto:team@momentumdemandsystem.com if you believe your account has been accessed without permission.

5. Fees and PaymentFees, billing schedules and terms are described in your Client Agreement or at checkout. Unless your Client Agreement states otherwise, advertising spend is paid directly to the advertising platforms and is separate from our fees. Late or failed payments may result in suspension of the Services.

6. No Guarantee of ResultsMarketing results depend on many factors outside our control, including your market, offer, pricing, responsiveness, staffing and platform changes. We do not guarantee any specific number of leads, appointments, sales or revenue. Any examples, demonstrations or figures shown are illustrative only.

7. Your Content and ResponsibilitiesYou keep ownership of the logos, images, videos, copy and other materials you provide ("Client Content"). You grant us a non-exclusive license to use Client Content to provide the Services. You confirm that you have the rights to all Client Content and that your offers, services and claims comply with applicable laws and advertising platform policies. You are responsible for any licenses or certifications required for your business or your advertising.

8. Health and Sensitive InformationPlease do not submit medical history, symptoms, medications, treatment photos or other health information through our website, forms, chat or messages. Our marketing and booking systems are designed to collect contact details and scheduling preferences only. Clinical and health intake should remain in your practice's own patient systems.

9. Intellectual PropertyThe MomentumDS name, logos, system design, templates, workflows, software, website content and materials we create for general use remain our property. Ownership of creative produced specifically for a client is governed by the Client Agreement.

10. Acceptable UseYou agree not to misuse the Services, including by attempting unauthorized access, interfering with their operation, sending spam or unlawful messages, or using the Services for any unlawful, misleading or harmful purpose.

11. SMS TermsBy providing your phone number and checking the consent box, you agree to receive text messages from Beyond Likability (MomentumDS) about demo appointments, reminders and customer care. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. You may also contact us at mailto:team@momentumdemandsystem.com. Consent is not a condition of purchase. Carriers are not liable for delayed or undelivered messages. Mobile numbers and SMS opt-in consent are never shared with or sold to third parties for marketing purposes. For more information, see our Privacy Policy.

12. Email CommunicationsBy submitting your information, you agree to receive emails related to your inquiry, demo or account. You can unsubscribe from marketing emails at any time using the link in the email.

13. Third-Party ServicesThe Services may rely on or link to third-party platforms, such as social media, advertising, calendar, payment and CRM providers. We are not responsible for third-party platforms, their availability or their policy changes, and your use of them is subject to their terms.

15. DisclaimersThe Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

16. Limitation of LiabilityTo the fullest extent permitted by law, Beyond Likability will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the three (3) months before the claim arose.

17. IndemnificationYou agree to indemnify and hold harmless Beyond Likability from claims arising from your Client Content, your products or services, your advertising claims, or your violation of these Terms or applicable law.

18. Suspension and TerminationWe may suspend or end access to the Services if these Terms or your Client Agreement are violated. Termination of paid services is governed by your Client Agreement.

19. Governing LawThese Terms are governed by the laws of the State of [State], without regard to its conflict-of-law rules.

20. Changes to These TermsWe may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continued use of the Services means you accept the updated Terms.
